Military lawyers have argued in a memo that the president has the authority to set aside laws as he sees fit and, therefore, just about anything subordinates do while under the president's orders should be permitted. Is this an argument for dispensing with the rule of law and substituting for it the rule of one person, a dictatorship, or is it a needed tactic in the war on terrorism?
