Biography:
Felix Frankfurter had strong liberal and progressive credentials long before he was appointed to the Supreme Court. He helped found the American Civil Liberties Union and did a lot to help President Roosevelt with his New Deal policies. Because of this background, his appointement raised a lot of concerns among conservatives, but his adherence to the philosophy of judicial restraint limited his support of civil liberties from the bench. According to Frankfurter, the most fundamental test for any law which a justice must use was the question of Rational Basis - if a rational basis for a law could be found, then the law should be considered constitutional.
