Fighting to Allow Gay Clubs at Schools

Sunday July 13, 2003
With the budgetary problems facing governments at all levels, you would think that agencies would avoid wasting funds foolishly - but not in Boyd County, Kentucky or in Lubbock, Texas. The Lubbock Independent School District has decided prevent students at Lubbock High School to form a gay-straight alliance (GSA), despite the fact that their own rules prohibit such a move.

The situation in Kentucky is especially perverse because the ACLU won an injunction against the district in federal court and both sides were sent to mediation because, according to the judge, the ACLU had a "strong likelihood" of winning at trial. According to reports:

If Boyd County loses at trial, which would surely be the case, the district could be liable for legal costs and fees. The ACLU estimates those could reach $300,000.

If people want to be martyrs to a lost legal cause, then they are welcome to assume that role for themselves - but it is an unethical breach of their duty as educators and public servants to waste public funds on their martyrdom, funds which could be used to repair schools, hire more teachers, or buy new textbooks.
