This Date in History: Marsh v. Chambers & Legislative Prayers

The Supreme Court permitted the practice of beginning the legislative sessions in Nebraska with a prayer given by the publicly funded chaplain. The Court relied almost entirely on historical practice and tradition — the Lemon Test, which should have been applied here by any reasonable justice, was completely ignored. Had it been applied, the defense of legislative prayers would have failed. It appears that the Lemon Test was ignored precisely to avoid this conclusion.
