June 24, 1957: Decided: Roth v. United States
The Supreme Court ruled that that 'obscene' material has no protection under the First Amendment. What is obscenity? What makes something obscene? Just how far can the government regulate material deemed to be obscene? Can the government ban obscenities? These are all important questions because, if the government can ban something that the government itself judges "obscene," then that material falls completely outside the protection of the First Amendment and those who wish to distribute such material will have little, if any, recourse against government censorship.
