An Oklahoma law providing for the sterilization of people found to be "habitual criminals" is struck down, based on idea that all people have a fundamental right to make their own choices about marriage and procreation. This right is not spelled out in so many words in the Constitution, but the justices argued that it is implied by the rights which are spelled out and is fundamental to any society which is free.


The IX Amendment to the constitution states, “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”
