Alabama: Sex Toy Ban Upheld

A divided three-judge panel of the Atlanta-based 11th U.S. Circuit Court of Appeals ... said in a ruling last July that siding with the sex toy merchants could open the door to the legalization of undesirable sexual behavior such as prostitution.
If the people of Alabama in time decide that prohibition on sex toys is misguided, or ineffective, or just plain silly, they can repeal the law and be finished with the matter," the court said. "On the other hand, if we today craft a new fundamental right by which to invalidate the law, we would be bound to give that right full force and effect in all future cases including, for example, those involving adult incest, prostitution, obscenity, and the like."
I fail to see how a right to sell items that will be used in the privacy of one's home would necessarily entail legalizing prostitution. Even if we grant that this connection could be made, though, how does that justify the ruling? Shouldn't courts reach decisions based upon what the law says about the case at hand, not judges' fears about how a decision might be (mis)used in the future? Such fears, if legitimate, can be addressed in the exact wording of the decision.

I was in AL recently, and I couldn’t get over just how backwards they are there. Everyone I spoke to could have been an extra on the King Of The Hill show, and the collective IQ seemed lower than a snake’s belly. It was likened unto a 30-year backwards time-warp. That said, I cannot for the life of me, understand why it would be otherwise OK for one to get off using their hands but not with a vibrator. Or, is it that these states are trying to ban getting off altogether ? Or is it some religious kick ? Is it all the above ? Is it just pure stupidity ?
The world may never know.
I also want to know how selling vibrators translates into prostitution, adult incest, and obscenity ? That’s absurd.
So, would one be correct to assume that no one in any of those states ever “gets off” ? They ONLY have “morally righteous sex” ??? I doubt it. What we seem to have here, is a bunch of Moral Orel’s and Clay Puppingtons running around trying to tell other people how to live every moment of their lives. And all the while, these same people are miserable. HEY ! Get off and enjoy !

This really upsets me, especially when I think about all the other things in the world going on that really need our governments attention like the WAR, health care, and violence and crime just to name a few things.
Who cares what CONSENTING ADULTS do in their own bedroom? Everyone should be allowed to enjoy their bodies in whatever shape or form they choose as long as they aren’t harming anyone else!

Liberals are so silly sometimes! In the first place, the ban wasn’t “upheld,” the Court simply refused to hear the case. If you don’t live in Alabama, what do you care? MYOB! If you do, then lobby the Legislature to change the law - or move to one of the 47 States that do allow it. The Flower Children of the 60’s are the Blooming Idiots of the 21st Century…
Well i think if ppl have to move from where they live, just to be able to do what they please in thier own home, then that doesnt make it a free country, and that doesnt make it a free state. that makes it a plain and simple dictatorship. People living in this country are promised 3 things from the time they are born. Life, Freedom, and the pursuit of happiness. when we let others dictate things as far as what goes on in the home or the privacy of the bedroom, then we are no better then the ppl we saying we are trying to free from the same thing. We and i say we as a country need to clean up our act and set our ppl free before we try to set others free, flower children…… well i think that the problem is that we elect and relect idiots that dont care about us as a country only themselves and that is all. we have freedoms here, this was the land of the free the last i had heard, but after hearing this im starting to think that the countries we are told are not free are the ones that are.
