Rehnquist and the Constitution

Tuesday February 3, 2004
The Rehnquist Court and the Constitution Recently Received: The Rehnquist Court and the Constitution, by Tinsley E. Yarbrough.

William Rehnquist has been one of the most important Chief Justices of the United States Supreme Court during the twentieth century. He has, without a doubt, made an important mark on American law - but how, and based upon what sort of legal philosophy? Tinsley E. Yarbrough explores a wide range of important cases dealing with issues like racial gerrymandering, pornography, displays of religious symbols on public property, libel of public figures, disposal of radioactive wastes, and possession of firearms in school zones, coming to the conclusion that far from defending a principles conservatism, the Rehnquist Court has instead been "arbitrary" and unprincipled.
